By browsing our website, registering an account, purchasing products, or using any services provided by MUNAUGHT PRIVATE LIMITED ("MUNAUGHT", "Company", "we", "us"), you agree to be legally bound by these Terms & Conditions ("Terms"). If you do not agree, you must immediately discontinue use of our platforms.
2. Services Offered
MUNAUGHT provides digital, sports technology, and internet infrastructure services, including but not limited to:
- Domain name registration, renewal, and transfer coordination
- Authoritative DNS services and domain forwarding
- Managed cloud hosting, server infrastructure, and VPS clusters
- SSL security certificates and business email infrastructure
- Sports management software, tournament suites, and live scoring systems
- Athlete profiling databases and digital passport registries
- Technology consulting, custom application development, and SaaS subscriptions
3. Eligibility and Authority
You must possess the legal capacity to enter into binding agreements under Indian law. If you access or order services on behalf of an organization, sports federation, academy, or corporation, you represent that you possess valid authority to bind that entity.
4. Account Responsibilities
Account holders must maintain accurate, current, and verifiable contact and billing information. You are solely responsible for safeguarding your login credentials, API tokens, and multi-factor authentication devices. All activities conducted under your account credentials are your responsibility.
5. Orders, Verification, and Fulfillment
Orders submitted through the console or website are subject to payment confirmation, identity verification, and third-party fulfillment availability. MUNAUGHT reserves the right to cancel orders if services are unavailable, material pricing errors occur, fraud is detected, or third-party fulfillment cannot be executed.
6. Pricing, Invoicing, and Taxes
Service prices are displayed in Indian Rupees (INR) or applicable international currencies. Prices shown during checkout govern the transaction. Applicable Goods & Services Tax (GST) or statutory taxes will be applied. Domain renewal pricing may differ from initial promotional registration rates.
7. Domain Services and Upstream Registries
Domain name availability searches are real-time queries and do not guarantee final registration until acknowledged by the authoritative registry. Domain registrations are fulfilled through third-party accredited registrars and registries and are governed by their respective registry agreements.
8. Domain Ownership and Registrant Obligations
The registrant is solely responsible for ensuring that the domain name does not infringe upon any third-party intellectual property or violate applicable laws. Registrants must keep WHOIS/RDAP records accurate.
9. Hosting and Infrastructure Usage
Cloud hosting and server allocations are subject to plan limits (bandwidth, storage, CPU, RAM) and must comply with our Acceptable Use Policy.
10. SaaS Platforms & Software Licenses
Access to MUNAUGHT SaaS applications (including Tournament Management, Athlete Profiling, and Live Scoring) is granted on a non-exclusive, non-transferable, subscription basis in accordance with purchased plan tiers.
11. Payments & Billing Cycles
Payments must be made in advance using supported payment gateways. Recurring subscriptions renew automatically unless cancelled before the renewal date.
12. Intellectual Property Rights
All software source code, algorithms, interface designs, logos, trademarks, brand assets, and documentation created by MUNAUGHT remain the exclusive intellectual property of MUNAUGHT PRIVATE LIMITED or its licensors.
13. Customer Content
Customers retain full ownership of lawful data, athlete profiles, tournament records, and media uploaded to our platforms. MUNAUGHT is granted only the technical license necessary to host, process, and transmit such content.
14. Prohibited Conduct
Customers agree not to utilize MUNAUGHT services for malware distribution, phishing, unauthorized scanning, denial-of-service attacks, spamming, copyright piracy, fraud, or unlawful activities.
15. Service Availability
MUNAUGHT strives to maintain high availability across all infrastructure as outlined in our Service Level Agreement.
16. Third-Party Integrations
Our platforms may integrate with third-party software, DNS networks, or payment processors subject to separate third-party terms.
17. Suspension & Termination
MUNAUGHT reserves the right to suspend or terminate services for payment default, material breach of terms, security threats, or compliance with court or regulatory orders.
18. Refund Rules
All refund and cancellation inquiries are governed by our Refund & Cancellation Policy.
19. Limitation of Liability
To the maximum extent permitted by Indian law, MUNAUGHT shall not be liable for indirect, incidental, punitive, or consequential damages resulting from service interruptions, domain registry actions, or third-party outages.
20. Force Majeure
Neither party shall be liable for failure to perform due to events beyond reasonable control, including natural disasters, telecommunication backbone failures, power grid disruptions, or acts of government.
21. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of India. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the competent courts having jurisdiction over MUNAUGHT's registered office in Jammu & Kashmir, India.
